Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using Gainr ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Gainr. Your continued use of the App signifies your acceptance of these Terms and any future modifications.

2. Not a Substitute for Professional Advice

IMPORTANT DISCLAIMER: Gainr is a fitness tracking application designed to help you log and track your workouts. Gainr is NOT a personal trainer, medical professional, or healthcare provider.

Please understand that:

  • The App does not provide medical advice, diagnosis, or treatment of any kind.
  • Workout suggestions, AI-generated programs, and any fitness recommendations are for informational and tracking purposes only.
  • You should always consult with a qualified healthcare provider, physician, or certified fitness professional before starting any exercise program, especially if you have any pre-existing medical conditions, injuries, or health concerns.
  • Always listen to your body and immediately stop exercising if you experience pain, dizziness, shortness of breath, or any other discomfort.
  • The App cannot assess your individual health status, physical limitations, or fitness capabilities.

3. Assumption of Risk & Liability Limitation

By using Gainr, you acknowledge and expressly agree that:

  • Physical exercise carries inherent risks of injury, illness, or even death. You voluntarily assume all such risks.
  • You participate in any workouts, exercise programs, or physical activities at your own risk and sole responsibility.
  • Gainr, its developers, affiliates, officers, employees, and partners shall NOT be held liable for any injuries, health issues, property damage, or any other damages (direct, indirect, incidental, or consequential) arising from your use of the App.
  • You are solely responsible for determining whether any exercise is appropriate for your current fitness level, health condition, and physical capabilities.
  • If you have any medical conditions, recent injuries, or health concerns, you MUST consult a medical professional before engaging in any physical activity.
  • You release Gainr and all associated parties from any and all claims, demands, or causes of action related to your use of the App.

4. Data Privacy & Storage

To provide our services, Gainr collects and stores certain data:

  • Personal information you provide (such as date of birth, gender, and weight)
  • Fitness profile data (including fitness level, goals, and available equipment)
  • Workout history, exercise performance data, and progress tracking

Your data is:

  • Stored securely using industry-standard encryption and security practices
  • Used solely to provide, maintain, and improve the App experience
  • Never sold to third parties for advertising or marketing purposes

5. Gainr Pro Subscription

Gainr offers both a free tier and a premium subscription called "Gainr Pro" that provides enhanced features and capabilities.

Free Tier

  • Create up to 2 custom workouts or programs manually
  • Generate up to 2 AI-powered workouts or programs
  • Access to all core workout tracking features
  • Full workout history and progress tracking

Gainr Pro

  • Unlimited custom workout and program creation
  • Unlimited AI-powered workout and program generation
  • Priority access to new features
  • All current and future premium features

Subscription Terms

  • Gainr Pro is offered as an auto-renewing subscription
  • Payment will be charged to your Apple App Store or Google Play Store account at confirmation of purchase
  • Subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current billing period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
  • You can manage and cancel your subscription through your device's App Store or Play Store account settings

Cancellation & Refunds

  • You may cancel your subscription at any time through your App Store or Play Store account settings
  • Cancellation takes effect at the end of the current billing period—you will retain Pro access until then
  • No refunds or credits are provided for partial subscription periods
  • Refund requests are subject to Apple App Store or Google Play Store policies

Price Changes

  • We reserve the right to change subscription pricing at any time
  • Price changes will not affect your current subscription period
  • You will be notified of any price changes before your next billing period

6. User Conduct

You agree to use Gainr only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the App or its systems
  • Interfere with or disrupt the App's functionality or servers
  • Use the App to transmit harmful code, viruses, or malicious content
  • Misrepresent your identity or provide false information
  • Use the App for any commercial purposes without authorization

7. Modifications to Terms

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. When we make material changes:

  • We will update the "Last Updated" date at the top of these Terms
  • We may notify you through the App or via email
  • Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms

If you do not agree to any modified Terms, you should discontinue use of the App.

8. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through appropriate legal channels.
